PRIVACY POLICY

Terms and Conditions for Services and Interpretation. The Privacy Policy is a Schedule to the Standard Terms and Conditions (the “Terms”) and is incorporated therein. Without limiting the generality of the Terms, the definitions and interpretation principles outlined in the Terms and the manner in which the Privacy Policy may be changed as outlined in the Terms apply in the Privacy Policy. If there are any changes to the Privacy Policy, CustomFit Knits Inc. (“CustomFit”) may make reasonable attempts to notify You, if possible, of such changes, but shall be under no obligation to do so. In the Privacy Policy, “You”, “Your” and similar words include a Customer, a Customer’s User and any Person who makes use of the Services or for whose benefit the Privacy Policy has otherwise been implemented, and “Information” includes Personal Information.  

Commitment to Privacy. CustomFit takes the privacy of its Customers, its Users, and other users of the Services seriously. CustomFit has developed the Privacy Policy to clearly set out its practices in relation to Personal Information. CustomFit wants to ensure that its Customers, its Users and other users of the Services and the public are aware of CustomFit’s commitment to the ten accepted principles of privacy; namely:

  2. Identifying purposes
  3. Consent
  4. Limiting collection
  5. Limiting use, disclosure and retention
  6. Accuracy
  7. Safeguards
  8. Openness
  9. Individual access
  10. Challenging compliance

POLICY AND CONSENT

Policy. The Privacy Policy governs Your use of CustomFit’s Services generally including CustomFit’s Website and other web interfaces and applications, and specific services more particularly provided for under the Terms. By using or accessing the Website and use of the Services, You agree to the terms of the Privacy Policy and expressly consent to CustomFit collecting, using and disclosing the Information specified herein for the uses set out herein.

Withdrawal of Consent. YOU MAY WITHDRAW YOUR CONSENT AT ANY TIME BY CONTACTING CUSTOMFIT THROUGH ITS WEBSITE OR AT THE ADDRESS BELOW. Where a Customer or any of its Users withdraws such consent, CustomFit may terminate the Customer’s Agreement or such User’s access to the Services without notice. No abatement or refund of Fees shall be made where CustomFit exercises its rights under this Section.

Accountability. The principles of privacy are derived from the Personal Information Protection and Electronic Documents Act, Canada (“PIPEDA”). The Office of the Privacy Commissioner of Canada (the “OPCC”) is responsible for administering PIPEDA and ensuring compliance. The OPCC can be contacted at https://www.priv.gc.ca.

PURPOSES, COLLECTION, USE, DISCLOSURE AND RETENTION

Purposes of Collection Generally. CustomFit is responsible for ensuring that CustomFit complies with the principles of privacy and PIPEDA. CustomFit achieves this by only collecting Information You are told is being collected and are willing to provide to CustomFit. Most importantly, CustomFit only collects Information which is necessary for it to provide the Services to You. The Privacy Policy describes the purpose of the collection of Information which includes:

  1. the delivery of unique and customizable knitting patterns for creating apparel that is tailored specifically to Your measurements (the “Services”), creating and delivery of content and advertising;
  2. researching, analyzing and auditing the Services, CustomFit’s systems, Website and other web interfaces and applications, and the Information in order to continue to provide the Services and to provide a personalized experience for Customers, Users and other users of the Services;
  3. ensuring and protecting CustomFit’s property and its rights and those of CustomFit ‘s Customers and Users and other users of the Services; and
  4. developing new Services or enhancing current Services.

Collection and Use of Personal Information. Generally, CustomFit will require only limited Personal Information from any individual. In accessing our Services, You provide CustomFit with certain Information which we collect and receive, including but not limited to account information such as name, contact information, measurements, buyer payment information, purchases and buying preferences. In some cases, we may need more specific Personal Information when You log into the CustomFit systems, Website, other web interfaces and applications, such as Your email address, name, account credentials, account password and internet protocol (“IP”) address. Such Information enables CustomFit to provide a personalized service, receive enquiries and requests for information and customer support, providing You with information about the resources and services available to You. 

Collection and Use of Analytics and other Non-Personal Information.

CustomFit may also collect certain Information automatically and may make use of and engage the services of third-party analytics providers (the “Analytics Providers”). Analytics Providers provide CustomFit with tracking Information by helping to collect, aggregate and prepare certain Information about how You use the Services as well as how the Services are performing. The Information that CustomFit and the Analytics Providers may collect, store and use include Your name, email, address, Your activity in using the Services, including the time spent on each page, content You access, Your account identifier, as well Your operating system, and operating system version and similar items. This Information enables CustomFit to build audience profiles, aid strategic development and analyze use of its resources.

Information related to any links You may click on from CustomFit’s Website and other web interfaces, or any applications of third parties that You may download from CustomFit’s Website and other web interfaces, may be collected and stored. In certain cases, this Information along with Your account information (which You set up with CustomFit in order for it to provide Services) may be combined in order to provide better service to You. 

CustomFit may share some of the Information CustomFit collects from You with vendors and other service providers (the “Third-Party Organizations”) who work with CustomFit to support the internal operations of the Services. Such Information will not be shared with Third-Party Organizations for purposes other than which it was originally collected or subsequently authorized and will not be used for direct marketing purposes; however, such Third-Party Organizations may use this Information to track, improve and otherwise deliver the applicable Services.

Communications with CustomFit. If You send CustomFit an email or other form of communication, CustomFit will only collect, retain, and use the Information you submit in order to address the subject of Your communication. The length of retention of this Information is tied to the issue at hand and will be destroyed as soon as the subject You wanted addressed has been dealt with, subject to retention on any backup systems operated by CustomFit.

Other Parties and Disclosure. CustomFit does not disclose Your Information to any Third-Party Organization other than as set out in the Privacy Policy, as required for the purpose of providing the Services to You or as required by PIPEDA. If CustomFit was to make other disclosure in the future for any particular instance other than as set out above, it would first obtain Your consent. CustomFit and its employees and agents will only access and use any Information as is required to provide the Services You want and for the purposes set out above. All CustomFit employees and agents are aware of the Privacy Policy and are required to always act in accordance with the Privacy Policy. CustomFit may also be forced to access, use, preserve or disclose Information when it, in good faith, finds that it is necessary to (i) satisfy any law, legal process or lawful governmental request, (ii) enforce an agreement with a Customer, User or other user of Services or investigate an issue related to a the Services provided to a particular Customer, User or other user, (iii) address, in any way, fraud, security or technical issues, or (iv) prevent harm to the rights and safety of CustomFit, its Customers, its Users and other users of the Services, or the public, as required or permitted by law.

Information Received from Third Parties. CustomFit may receive Information from third parties which provide the Services or assist CustomFit in providing the Services via such third parties’ website and other resources. This Information will be limited to the type of Information set out above and will be dealt with in accordance with the Privacy Policy. For example, when You use or connect to CustomFit’s website and other web interfaces or access such resources by or through a third-party platform, You allow CustomFit to access and collect certain Information from Your third party platform profile and account. You also allow CustomFit to access Information contained in cookies placed on Your device by the third-party platform as permitted by the terms of Your agreement and privacy settings with such third party platform. 

Third Parties. CustomFit is prudent in picking its partners and in allowing such partners’ sites to be linked with CustomFit, including its website and other web interfaces and applications. Notwithstanding such prudence, any Information You share with these third parties is governed by their respective privacy policies and You should review such policies before You provide such third parties with any Information.

ACCURACY, OPENNESS, INDIVIDUAL ACCESS AND SAFEGUARDS

Accuracy. CustomFit’s Information comes from its Customers, Users and other users of the Services and as a result should be accurate when submitted. CustomFit does not change or otherwise amend or alter this Information so it should remain accurate.

Individual Access and Corrections. If You have any concerns about the accuracy of Your Information, You can contact CustomFit as set out above and provide CustomFit with updated Information, ask that CustomFit delete Your Information or ask to see all of Your Information to ensure that it is accurate. CustomFit will make reasonable efforts to promptly deal with all such requests. If You are making such a request, please ensure You identify yourself and the Information You are inquiring about as otherwise CustomFit may not be able to process Your request. In limited circumstances, CustomFit may not be able to satisfy a request because, among other reasons, it would be extremely impractical as a result of the nature of the request, or the request may relate in part to Information of others or the Information may be required for CustomFit to comply with the Privacy Policy. These types of requests are rare and CustomFit will always use reasonable efforts to process all requests. If CustomFit is not able to process a request, it will make reasonable efforts to tell You why in writing.

Security and Other Safeguards. The security of your Personal Information is important to us. We take safeguards to protect Your Information through technical and administrative measures designed to mitigate the risk of unlawful or unauthorized access and disclosure of Your Personal Information. To protect Your account, we encourage you to choose your password carefully. Personal Information provided to CustomFit is processed on CustomFit’s servers and on the servers of CustomFit’s partners and consultants to provide the Services and is managed in accordance with the Privacy Policy.
